Privacy Policy: Deval Patrick Committee Website

Welcome to DevalPatrick.com, a website we've designed to foster political debate, and allow Massachusetts citizens to organize around key issues. The site is also designed to allow the Governor to comment on issues and points that he believes are of particular importance.

1. Your Privacy

We at DevalPatrick.com are committed to maintaining -- in the manner you specify -- the privacy of information you share with us while visiting our site and interacting with us online. We believe that the best privacy policy for a "political exchange" site (like our Site) is a policy that allows each visitor (i) to participate in the debate and exchange to the extent he or she wishes, and (ii) to share Personal Information proportionate to this participation. Participants on the DevalPatrick.com website, therefore, choose how much personal information they wish to share online, and gauge their involvement accordingly. For example, a visitor to our Site who wishes simply to observe would provide little, if any, personal information, or information about his or her political views. In contrast, a visitor who wishes, via our Site, to organize voters around a decisive issue would necessarily provide information concerning his or her political views, as well as contact information, and other personal information to create a communications "focal point."

This privacy policy and agreement (the Privacy Policy or Policy) embodies the above philosophy of "participant's choice." The Policy, accordingly, covers how, with your permission (as set out below) we collect, use, and treat Personal Information that you may provide through the DevalPatrick.com website (the "Website" or the "Site") or while participating in the organizing and debating activities that take place at the Website (the Political Exchanges).

The terms "you" and "your" refer to any visitor to the Website, including (i) casual visitors to our Site, who do not participate in the Services (Site Visitors), (ii) individuals who wish to participate in the Political Exchanges that take place at our site, and register at our Site to participate in this manner (Participants); and (iii) individuals who wish to coordinate discussions, debates, and organizing activities on the Site (and who qualify for these tasks) (Coordinators). The terms "Committee", "we" and "us" refer to the Deval Patrick Committee, and the term "DevalPatrick.com" refers to our website. For your convenience, Section 20 provides a full set of definitions used in this Privacy Policy.

Individuals who wish to contribute to the Deval Patrick Committee (Donors) should refer to our Donor Privacy Policy.

2. The Purpose of Our DevalPatrick.com Website

This website has already allowed thousands of citizens from across the state to connect with each other about issues in a way that has never before been readily available. There are currently citizens on this Site discussing education funding, renewable energy, tax policy and other issues. In some cases, local, elected officials have posted their opinions and feedback as well.

We think this is an exciting new chapter in civic engagement.

3. Your Consent

Please read this Privacy Policy carefully; when you consent to this Policy's terms, it creates legal obligations on you and on the Deval Patrick Committee. We ask you to show your consent to the terms of this Privacy Policy in different ways, depending on your relationship to the Site. The procedures for consenting to this Policy are (a) less formal if you are simply a casual Site Visitor, and (b) more formal if you are seeking to become a Participant, Coordinator, or Donor.

3.1 Consent by Site Visitors.
By accessing and using our Website as a Site Visitor, you are acknowledging that you have read and understood this Privacy Policy and agree to be legally bound by it. If you do not agree with the terms of this Privacy Policy, please refrain from using our Site.
3.2 Consent by Participants, and Coordinators.
If you register as a Participant or a Coordinator, you will be prompted to click an "I Accept" button linked to this Policy during the registration process. Clicking "I Accept" confirms your agreement to be bound by this Privacy Policy.
3.3 Connection to Terms of Use.
Clicking the "I accept" button will also confirm your agreement to comply with the "Code of Conduct" and other terms contained in our Terms and Conditions of Use. If you are registering as a Participant or a Coordinator, please review the Terms and Conditions of Use carefully, as they describe acceptable conduct by Participants and Coordinators.

4. "Online Town Meeting" Participation and Verification

When you register to post on DevalPatrick.com, we ask (but do not require) that you use your real name. One of the central points of the Deval Patrick Committee website is to foster communication about public issues. Our users range from ardent supporters who are eager to receive frequent updates about Governor Patrick's activities, to skeptics who may disagree with the supporters, but who are just as interested in shaping our common future.

4.1 The Town Meeting As "Template" For Our Site.
With this range of potential viewpoints on our Site, we looked for a traditional form of discourse that we could use to inform the way we structure the discourse on our Site. We think that a traditional town meeting provides the best "template" for the Site. Traditional town meetings have served and continue to serve the Commonwealth well, and we think these same general structures will foster the discourse we seek to encourage on our Website. Accordingly, we created this Site in the same spirit as a traditional town meeting.
4.2 Use Of Real Names In Town Meeting.
In a traditional town meeting, citizens check in by name and, when a citizen participates in the meeting, the citizen does so in his or her own name. Like a traditional town meeting, on our Site we encourage each visitor to use his or her real name and real contact information when registering (although you are not required to do so). In addition, we may choose to "verify" the information a visitor provides, to allow us to gauge whether the visitor "is" who he or she says. We do this to assist with the "quality" of the information our visitors provide. Although we fully permit visitors to use fictitious names on the Site, we would prefer to avoid relying on fictitious names for the more serious political and organizational efforts that may take place through our Site.
4.3 Verifying Information, While Maintaining Privacy Controls.
This Verification process uses information that is available from public sources or other authorized sources available to the Committee. The Verification process links (a) information that a visitor provides during registration to (b) public information concerning Massachusetts citizens and registered voters, to "match" a registering visitor to a citizen. We believe this structure encourages our visitors to consider their positions carefully, as they engage in Political Exchanges over our Site. Please note that, although we encourage visitors to provide us with this information, no visitor or Participant on our Website is required to share his or her real names (or other on identifying information) with others on our Website, unless they affirmatively volunteer this information, as further described below.
4.4 Avoiding Redundant Information.
During the registration process, once you have entered sufficient information, you may see data populating certain fields automatically. This is data supplied as part of our verification process. If this data is inaccurate, you should ignore it and type over it. If the data is accurate, you can still choose to type over it and create an account from scratch. If you adopt this option, you may wind up getting redundant emails, duplicate mailings and the like, as our systems will assume from your registration that "you" are actual two or more different people. Also, if our information about your preferences is fragmented, we may send you information that you don't want, or fail to send you information that you do want.

In sum, think of this Website as a form of "online town meeting." We have attempted to duplicate the "forum for discourse" that a town meeting provides, while adapting this structure of the online world, and users desire to stay in control of their Personal Information.

As with any website, you do need to be on guard that people may not be who they say, especially for posts claiming to be from public figures.

5. The Types Of Information You May Provide

Information you may provide while visiting our Site or while participating in our Services falls into three broad categories: (i) Personal Information; (ii) information concerning your position on political issues; and (iii) aggregate information. We use the term Personal Information to mean any information you provide to us over the Site that could reasonably be used to identify you, including your name, address, e-mail address, birth date, financial information, telephone number or any combination of such information that could be used to identify you. We use the term Position Information to refer to information you may provide concerning your position on political and other public issues. Anonymous Information is information that does not identify you, and may include statistical information concerning, for example, users' participation in Political Exchanges, users' access to discussions run by specific Coordinators, or the pages on our Site that users visit most frequently.

These three categories of information can be further divided into (iv) information that we collect from, and that you provide to us (Site-Directed Information), and (v) information you intend to provide or make available to Participants and others on our Site mkref0 ("defn_participant_directed", "Participant-Directed Information"); ?>. Our Privacy Policy governs all Site-Directed Information -- whether this information is Personal Information, Position Information, or Anonymous Information -- and does not govern Participant-Directed Information. This Privacy Policy does not govern Participant-Directed Information because you retain full control over how much or how little information you choose to share in your Participant-Directed communications, and we have no direct control over your choice of what to share in Participant-Directed communications or what recipients of these communications choose to do with this Information. Accordingly, although we provide you with guidance on "good information practices" in your Participant-Directed communications, we are not responsible for these communications.

6. The Relationship Between Information You Provide At Our Site, And Information From Voter Lists and Other Offline Sources

This Privacy Policy applies to information that you provide through using our Website. This Privacy Policy does not apply to information you provide to the Committee, or the Committee obtains, through other means. For example, the Committee may obtain information from voter lists, or other sources removed from this Website (collectively, Non-Website Information). This Privacy Policy does not govern the Committee's use or handling of Non-Website Information. If you, for example, remove your Personal Information from the files of this Website under Section 13 (Changing or Removing Information; Opting Out), that does not mean your information will be removed from the Committee's files concerning Non-Website Information.

7. Site-Directed Personal Information; Our Uses Of This Information

We share Personal Information you provide to us via the Website only as provided in this Policy, and only for purposes of Political Use. Specifically, we do not give others the right to use such information for anything other than Political Uses. Where organizations and persons (including our Coordinators ) commit to using the Information for Political Uses only, we will share this Information with them.

We collect information from Site Visitors, Participants, and Coordinators at different points on our Website and through our Services, and use this information as follows:

7.1 Registration Information; User Names.
In order to participate as a Participant or Coordinator in our Services, we require that you complete a registration form. This form asks for contact information, which includes such items as (i) name; (ii) mailing address; and (iii) email address. The registration process provides Participants and Coordinators with a user name and password, which allow them to gain access to the Website and Services to which they have subscribed. Our system relies on user names as the public "identifier" for the particular Participant.
7.2 Information from Coordinators.
By creating an Issue on MyIssue, you become a Coordinator. When you become a Coordinator, other users of the system will be able to send you messages using a form on the web site. These messages will be delivered to you by email, and will include the return email address for the author of the message. If you want to continue the conversation, you can do so in ordinary email, without the further involvement of DevalPatrick.com.
7.3 Email Addresses.
We use your e-mail address to send notifications relating to our Site, including for example, to confirm when one Participant has requested to add you as a Participant, to provide notice that a Participant has received a message or comment from you, and to invite others to join in the exchange on DevalPatrick.com. If you choose to directly contact the Coordinator of a Group you are involved in via email, then you will reveal your email address to the Coordinator.
7.4 Invitations to Third Parties.
Participants and Coordinators are able, at our Site, to use our "invitation service" to inform others about their issues, and to encourage others to register at our Site. If you choose to send such a invitation, we will ask you for a name and email address. We will then send an email invitation asking the person to visit the site. We store the information for the sole purpose of sending these emails, and the person you have invited may contact us in accordance with Section 13 (Changing or Removing Information; Opting Out) to request the removal of this information from our databases.
7.5 Communications with Other Participants.
In registering under the Website, Participants and Coordinators indicate an interest in exchanging information with other Participants, subject to any Privacy Controls imposed. To allow such communications, we provide information to identify individual users, in the form of Participants' and Coordinators' user names. We seek to limit the information provided through our system to the minimum information needed to identify a Participant in communications and other exchanges.
7.6 Other Information Exchanges.
The Website allows Participants and Coordinators (i) to provide and receive information in a range of forms on an unlimited number of topics, and (ii) to engage in other activity through Website discussions that may include, at the option of the user, an exchange of Personal Information. In these instances, we use any information you provide to us strictly for the purposes for which you submit the information.
7.7 Use of Profiles in Promotions.
We believe that our Participants' own experiences on the Site can often act as the strongest promotion for the Site and our Services. To promote and illustrate our Services and the Site, therefore, we may wish to post on our Home Page, and in other areas of the Site, profiles and other Content of our Participants. If we have used your profile or other information for these purposes, and you do not wish us to do so, please notify us as provided in Section 20 (Contact Us). If Personal Information is involved, we will remove the information from our promotional material, within a reasonable period of time.
7.8 Informational Notices and Bulletins.
Periodically, we may choose to send news, bulletins, or other information to Participants and Coordinators, and will use Personal Information to send such communications. If we choose to undertake such communications, you will have the ability to opt out of receiving these communications as provided in Section 13 (Changing or Removing Information; Opting Out).
7.9 MyIssue.
As one of our Services, we offer a forum for political exchange that we refer to as "MyIssue". We make only your user name available to other users of these services. Any comments you contribute to the online dialog, however, become public immediately, attributed to your user name. You should, therefore, use discretion in what you submit to these exchanges.
7.10 Surveys.
Periodically, we may initiate surveys at DevalPatrick.com, and we may request Personal Information from you in connection with such surveys. You are free to choose whether you participate in this type of survey. The information we request may include contact information (such as name and email address). Survey information will be used for purposes of monitoring or improving the use and appeal of this Site, and related Political Exchanges. We will notify you of relevant details in connection with asking for you participation in such surveys.

8. Your Responsibility for Participant-Directed Information

Participant-Directed Information is information you intend to provide or make available to other Participants or Coordinators on our Site. Although we counsel you to take care if you include Personal Information in your Participant-Directed Information, our Privacy Policy does not cover Participant-Directed Information. If you choose to disclose any Personal Information, any such information can be collected and used by other Participants or users, and you may receive unsolicited communications as a result. We provide a range of Services to assist you in making good choices concerning the information you disclose. Please see Section 12 (Further Tools for Protecting Your Privacy) for a description.

9. Anonymous, Aggregate Information.

We use Anonymous Information to analyze the effectiveness of our Site, to improve our Services, and for other similar purposes. In addition, from time to time, we may undertake or commission statistical and other summary analysis of the general behavior and characteristics of users participating in our Services and the characteristics of visitors at our Site, and may share Anonymous Information with third parties, including Advertisers. Rest assured, though, that Anonymous Information provided to third parties will not allow anyone to identify you, or determine anything personal about you. We may collect Anonymous Information through features of the software that supports our Services, through cookies, and through other means described below.

9.1 IP Addresses; Logs.
The Deval Patrick Committee may automatically receive and record information in our server logs from your browser, including your IP address (the Internet address of your PC), your computer's name, the type and version of your web browser, referrer addresses, where the computer is routing from, and other generally-accepted log information. We may also record page views (hit counts) and other general statistical and tracking information, which will be aggregated with that of other users in order to understand how our Website is being used, and for security and monitoring purposes.
9.2 Cookies.
A cookie is a small amount of data, which often includes an anonymous unique identifier, which is sent to your browser from a website's computers and stored on your computer's hard drive. Cookies can be used to provide you with a tailored user experience and to make it easier for you to use a website upon a future visit. We may include cookies on our Website and use them to recognize you when you return to our Website. You may set your browser so that it does not accept cookies. Cookies must be enabled on your web browser, however, if you wish to access certain personalized features of our Services.
9.3 Tags.
We may use so-called "pixel tags" --- small graphic images (also know as "web beacons", "single-pixel GIFS", or "Web bugs") --- to tell us what parts of our website have been visited, to measure the effectiveness of searches customers perform on our Site, and for other purposes. Pixel tags also enable us to send email messages in a format customers can read, and they inform us whether emails have been opened, to help ensure that our messages are of interest to our Participants and Coordinators. None of this data includes Personal Information, and you can "opt-out" of receiving these types of emails from us by following the directions provided in Section 13 (Changing or Removing Information; Opting Out). If any Personal Information is collected using such tools, it will be subject to the terms of this Privacy Policy.
9.4 Click-Throughs.
We may send email messages which use a "click-through URL" linked to content on our Website. When you click one of these URLs, you pass through our web server before arriving at the destination web page. We tracks this click-through data to help determine interest in particular topics and measure the effectiveness of our customer communications. If you prefer not to be tracked simply do not click text or graphic links in the email, or notify us in accordance with Section 13 (Changing or Removing Information; Opting Out).
9.5 Banners of Other Organizations.
The Services may include the use of banners of other organizations we support. These banners are for the serving and/or targeting of political messages, campaign messages, and other forms of Political Exchanges. These banners may be provided, in some cases, by a third party service provider ("Banner Service Providers"). These Banner Service Providers may use traditional banners, or other methods. A Banner Service Provider may place or utilize its own cookie on your browser, and may use Anonymous Information about your visit to our sites, such as the number of times you have viewed the banner. If the Banner Service Provider requests that you provide to it Personal Information, please be aware that this Banner Service Provider's use and collection of this information will be governed by its own privacy policy, and not our Policy. We recommend that you review the Banner Service Provider's privacy policy before providing Personal Information.

10. Any Information Linked With Your Personal Information Is Protected As "Personal Information"

To enable us to better understand the characteristics of our Customers and/or to provide services tailored to your needs, we may link (a) the Personal Information you have provided; with (b) Anonymous Information. If we combine or link any Anonymous Information or other information with your Personal Information, the resulting combination will be treated and protected as Personal Information under this Privacy Policy.

11. Disclosures To Third Parties

At our option, we will disclose your Personal Information to unaffiliated third parties without your express consent in the following circumstances:

11.1 Third Party Political Use.
You agree that we may rely on and share information with political committees and others, provided the recipients of this Information agree to employ the information for Political Uses only (Third Party Political Use). We will use reasonable efforts to obtain a written commitment to this effect from recipients of Personal Information provided via our Website. You acknowledge, however, that beyond making such efforts, we are not responsible for the conduct of a recipient of this Information.
11.2 "Downstream" Recipients.
You agree that recipients of Personal Information under this Website for Third Party Political Use may further share such Information "downstream," provided downstream users similarly agree to use the information for Political Uses only.
11.3 Site Vendors.
We may employ other companies to perform functions on our behalf, such as maintaining the Website, providing services related to the Site, collecting information, responding to and sending electronic mail, or other functions necessary to our business. We may need to share your Personal Information with these companies (collectively, "Site Vendors"). We will provide Site Vendors with only that information necessary to perform their functions, and we will not allow them to use your Personal Information for any other purpose.
11.4 Questions of Harm.
We may reveal your Personal Information on a case-by-case basis to attorneys, private investigator organizations or law enforcement agencies if we believe (a) that you are in risk of harm from another, or (b) that you are harming or interfering (or will harm or interfere) with others or violating (either intentionally or unintentionally) our Terms and Conditions of Use or otherwise violating legal rights.
11.5 Legal.
The Deval Patrick Committee will reveal your Personal Information, to the extent we reasonably believe we are required to do so by law. If we receive legal process calling for the disclosure of your Personal Information we will attempt to notify you via the email address you supplied during registration within a reasonable amount of time before we respond to the request, unless such notification is not permitted.
11.6 Transfer of Site.
The Deval Patrick Committee shall be entitled to transfer to a third party information it collects, including any Personal Information, in connection with a sale of all or substantially all of the assets of the business entity responsible for the information under this Policy, provided the acquiring third party has agreed to safeguard your Personal Information with protections that in all material respects are the same as or more protective than those set out in this Privacy Policy.

12. Additional Tools for Protecting Your Privacy

We recognize that users may provide more Personal Information than they intend, or should, over the public areas in social networking sites. We provide a range of Services to assist our Participants seeking to preserve an appropriate level of privacy, including the following:

12.1 Privacy Controls.
We provide you with privacy controls, that allow you to flag as inappropriate postings to our Site. In addition, in MyIssue and other locations where Political Exchange may take place on the Site, only your first and last initials will appear, as your user name, to further allow you to control your Personal Information (collectively, our "Privacy Controls"). Please either employ the Privacy Controls, or choose carefully the information you post on the Site, and that you provide to other Participants. You should take care if you choose to include information that personally identifies you, such as your telephone number, street address, last name, email address, and any geographically recognizable photographs.
12.2 Reporting of Problems.
If you feel that you or someone you know has been harassed or bullied on our Site, or that users have infringed on your privacy or violated our Code of Conduct, please report your concerns, as set out in our Terms and Conditions of Use.

13. Changing or Removing Information; Opting Out.

13.1 Discretionary Account Information
To allow appropriate control over Personal Information, you can access your account (after supplying your user name and password) to change your comments or your password.
13.2 Opt-Out.
If we choose to send to you bulletins, updates, or other communications, including fund-raising related materials, we will provide you with the ability to decline -- or "opt-out of" -- receiving such communications. Instructions for opting-out will be provided if and when we determine to send you such a communication. Please understand that you will not be allowed to "opt--out" of formal notices concerning operation of this Website, and legal and other related notices concerning your relationship to the Site.
13.3 Deleting Information Provided Via This Website.
Finally, if you have provided us with Personal Information in connection with your use of this Site, upon your request, we will remove this Personal Information from our Website databases. Please understand, however, that it may be impossible to remove this information completely, due to backups and records of deletions. In addition, please understand that, if you request deletion of your information, you will be unable to utilize associated features of the Website and any associated Services. You may not remove de-identified, anonymous, or aggregate data from our databases.
13.4 Limitations on Deleting Information; Public Databases and Non-Website Information.
As provided in Section 6, please keep in mind that this Privacy Policy applies only to information provided through this Website, and does not apply to Non-Website Information, which is information the Committee obtains or is provided via other channels, such as public databases. Therefore, if we remove information from our Website databases in accordance with Section 13.3 (Deleting Information Provided Via This Website), this will not remove Non-Website Information from our databases. We will retain this Non-Website Information in our databases, including Personal Information that may relate to our users, where applicable law permits us to retain the Information. 14. Security

We have put in place security systems designed to prevent unauthorized access to or disclosure of personally identifiable Site-Directed Information you provide to us, and we take all reasonable steps to secure and safeguard this Information. Our site's password-protected area requires users to give us unique identifiers such as their user id and password. Employees of the Deval Patrick Committee (and employees of our affiliates and Site Vendors) are required to acknowledge that they understand and will abide by our policies with respect to the confidentiality of Personal Information.

Our security systems are therefore structured to deter and prevent unauthorized access to information you provide to us. We also use software programs to monitor network traffic to identify unauthorized attempts to upload or change information, or otherwise cause damage. Please understand, though, that this information should not be construed in any way as giving business, legal, or other advice, or warranting as fail proof, the security of information provided by or submitted to the Deval Patrick Committee. Due to the nature of Internet communications and evolving technologies, we cannot provide, and disclaim, assurance that the information you provide us will remain free from loss, misuse, or alteration by third parties who, despite our efforts, obtain unauthorized access.

15. Notice of Security Incident

If we detect, despite the safeguards set out above, an intrusion or other unauthorized access to or use of Personal Information (an "Intrusion"), we will (i) notify effected users of the Intrusion if the information at issue is sensitive, as determined by law, (ii) deliver this notice by the means we deem most efficient under the circumstances (such as, for example, first class mail or email); (iii) use contact information for each effected user that is current in our files; and (iv) use commercially reasonable efforts to accomplish these steps and effect this notice in a timely manner. To the extent applicable law requires steps in addition to those specified above, we will under all circumstances comply with applicable law.

16. Notification of Changes

From time to time, the Deval Patrick Committee may change its Privacy Policy. If we make any changes regarding disclosure of Personal Information to third parties, upon your next login we will inform you of the modified policy. We will post notice of the new Policy from the privacy link on our Website. With respect to Site Visitors, your use of our Site following any such change constitutes your agreement to follow and be bound by the Privacy Policy, as changed. With respect to Participants and Coordinators, no such changes will take effect unless and until you have provided us with your consent to such changes, in accordance with Section 3.2 or Section 12, above.

17. Relationship to Terms of Use and Other Contracts

This Privacy Policy must be read in conjunction with our Terms and Conditions of Use, and the provisions of our Terms and Conditions of Use are incorporated herein. To the extent the Terms and Conditions of Use conflict with the terms of this Privacy Policy, the terms of this Privacy Policy will control.

18. Participation by Children and Teens; Advisory

Our interest in protecting the privacy of our users, and allowing our users to choose the level of information they provide, applies particularly to younger visitors to our Site. Younger visitors may not understand the potential drawbacks of sharing Personal Information while participating in Political Exchanges on our Site. Therefore, due to this concern, and due to federal policy in favor of protecting children under 13 years of age (as reflected in the Children's Online Privacy Protection Act), WE DO NOT ALLOW INDIVIDUALS WHO WE KNOW ARE UNDER 13 TO PARTICIPATE IN OUR SITE OR SERVICES. Please understand that we cannot necessarily tell if a user is providing us with his or her true age.

YOU MUST BE AT LEAST 13 YEARS OLD TO USE OUR SITE AND SERVICES. IF YOU ARE BETWEEN 13 AND 17 YEARS OF AGE, PLEASE REVIEW THIS AGREEMENT WITH YOUR PARENT OR GUARDIAN.

20.1 "Additional Information"
means information beyond the information provided by the User via the Website. "Additional Information" consists of information that is publicly available to the Committee. Examples of "Additional Information" include (i) information obtained from telephone listings, (ii) information from voter registration lists made available by the Secretary of State's Office; and (iii) other similar information.
20.2 "Anonymous Information"
means information that does not identify you, and may include statistical information concerning, for example, users' participation in Political Exchanges, users' access to discussions run by specific Coordinators, or the pages on our Site that users visit most frequently.
20.3 "Coordinator"
